These terms and conditions (these “Terms and Conditions”) govern your (“you” or “your”) access to and use of the Pipsticks.com website (the “Website”) and all services provided by Pipsticks via the Website including without limitation our monthly subscription service for stickers and related items (collectively, the “Services”).

The Services include the delivery of stickers and related items (the “Products”). Access to the Website, use of the Services, and purchase of the Products is subject to these Terms and Conditions and the Pipsticks Privacy Policy available on the Website.

ACCEPTANCE OF TERMS

By using our Website or subscribing to our Services, you indicate your unconditional acceptance of the following Terms and Conditions. Please read them carefully, as they may have changed since your last visit.

WEBSITE CONTENT

Pipsticks maintains this Website as a service to the user community that visits the Website subject to these Terms and Conditions. We may alter, suspend, or discontinue this Website or the Services in whole or in part, at any time and for any reason, without notice. The Website may also periodically become unavailable due to maintenance or malfunction of equipment or for other reasons.

Users have a personal, non-transferable, non-exclusive right to access and use the Content of this Website subject to these Terms and Conditions. The term “Content” means all information, text, images, data, links, software, or other material accessible through the Website or Services, whether created by us or provided by another person for display on the Website or through the Services.

The Content may contain typographical errors, other inadvertent errors or inaccuracies. We reserve the right to make changes to document names and content, descriptions or specifications of products or services, or other information without obligation to issue any notice of such changes.

RETURNS, REFUNDS, AND EXCHANGES

As you know, we’re big on HAPPY around here. Which is why we’ve got a Happiness Guarantee for all our products – If you don’t like something you receive send it back (no hard feelings!)... You have 30 days to return an item. All returns require prior approval from PIPSTICKS and a Return Authorization Number (RA#) will be provided once approved. We offer a refund to the original method of payment (minus the cost of return shipping) on all products if the item is returned unused, in the original packaging.

Products marked with "All Sales Final", along with any Sale and Clearance products like mystery bundles are not included in this policy and cannot be returned.

Please note that special collections and designer collaborations may also be subject to a different return policy.

Our Customer Service Squad is happy to get you everything you need for a successful return. You are responsible for the cost of the return shipping (it will be deducted from your refund) for all products that are being returned unless otherwise specified by our Customer Service Squad.

The item will be returned via USPS mail using the return label accessed through our Returns Portal. This label is pre-paid and pre-addressed, and the return shipping fee will automatically be deducted from your refund. If you need to process a return, please reach out to our team at hello@pipsticks.com

DAMAGED, INCORRECT, or MISSING ITEMS: If you received a damaged item, incorrect item, or something was missing from your shipment (so sorry!), we will immediately send a replacement item or offer a full refund (including any return shipping fees) for the item. Please reach out to our Customer Service Squad at hello@pipsticks.com for further assistance. If your product is damaged or missing an item, please send over picture of the product with your email!

MISSING SUBSCRIPTION PRODUCTS: The shipping & delivery dates for your subscription are dependent on two things: your billing/signup date and your location. You'll get a shipping notification email when we drop them in the post! Please review our FAQ for detailed information on shipment and delivery times. If your delivery time has passed and you have still not received your shipment, please email our Customer Service Squad at hello@pipsticks.com for further assistance. Repeated claims of undelivered merchandise may result in the cancellation of your membership.

REFUNDS FOR RETURNED PRODUCTS: Your refund will be issued via the same payment method used for the original purchase. Shipping and handling costs are non-refundable, and the cost of the return shipping will be deducted from your refund unless otherwise specified by our Customer Service Squad. When your return is received by Pipsticks, you will receive an email confirmation listing the items we received, their condition, and the refund value. Please allow up to 2 weeks for the credit to be reflected in your account. Allow up to 2 billing cycles for the credit to appear on your credit card statement.

REFUNDS WHEN PAID WITH GIFT CARDS: If you return items that were paid for using a Pipsticks Gift Cards, then you will be issued an e-gift card for the full refund amount.

REFUNDS WHEN SPLIT BETWEEN A GIFT CARD & CREDIT CARD: If you used a combination of payment methods, you will first be refunded with an e-gift card and the rest will be refunded to the credit card you used at the time of purchase.

LOCAL TAXES

You may be charged local sales tax or VAT, if applicable.

INTERNATIONAL ACCESS

This Website may be accessed from countries other than the United States. This Website and the Services may contain products or references to products that are only available within the United States and U.S. territories. Any such references do not imply that such products will be made available outside the United States. If you access and use this Website outside the United States you are responsible for complying with your local laws and regulations.

ORDER & SUBSCRIPTION CANCELLATIONS

Pipsticks may cancel orders for any reason, (ie: the item is out of stock, pricing errors, credit card payment is declined by the issuing financial institution). We may terminate your membership, without notice, for conduct we believe violates these Terms and Conditions or our policies, is harmful our business interests, or for an inactive account.

ORDER CANCELLATIONS: As soon as you submit payment your order is processed and pending shipment. We cannot guarantee that an order can be cancelled after payment is submitted. Once an order is shipped, the Return and Exchange Policy will apply.

SUBSCRIPTION CANCELLATIONS: We work hard to ensure all members are satisfied with their subscription. You may cancel your ongoing subscription at any time through your Pipsticks account on the Website. You must update your account on the Website no later than two (2) business days before your scheduled billing date to cancel this months shipment. IF YOU DO NOT CANCEL PRIOR TO YOUR BILLING DATE, YOU WILL BE CHARGED FOR THAT MONTH’S SHIPMENT OF PRODUCTS.

LIMITATION OF LIABILITY

In this case, the adult is the user and is responsible for any and all activities, subscribers and purchasers.

ENFORCEMENT

Except for any claim seeking the exercise of the injunctive or equitable powers of a court of competent jurisdiction, any action to enforce or interpret this Agreement, or to resolve disputes with respect to this Agreement, shall be settled by arbitration in accordance with California Code of Civil Procedure Sections 1280 through 1294.2 and any successor provisions thereto.  The provisions of California Code of Civil Procedure Section 1283.05 regarding the right to take depositions and obtain discovery shall apply to the arbitration.  Arbitration shall be the exclusive dispute resolution process.  Any party may commence arbitration by sending a written demand for arbitration to the other parties.  Such demand shall set forth the nature of the matter to be resolved by arbitration.  The place of arbitration shall be in the County of San Luis Obispo, California.  The substantive law of the State of California shall be applied by the arbitrator to the resolution of the dispute.  The parties shall share equally all initial costs of arbitration.  The prevailing party shall be entitled to reimbursement of attorneys' fees, costs, and expenses incurred in connection with the arbitration.  All decisions of the arbitrator shall be final, binding, and conclusive on all parties.  Judgment may be entered upon any such decision in accordance with applicable law in any court having jurisdiction thereof.  The arbitrator (if permitted under applicable law) or such court may issue a writ of execution to enforce the arbitrator's decision.  Under no circumstances shall the arbitrator be authorized to award punitive damage awards, including, but not limited to, federal or state statutes permitting multiple or punitive damage awards.  Any purported award of punitive or multiple damages shall be beyond the arbitrator's authority, void, and unenforceable.

SEVERABILITY

If any part of these Terms and Conditions is held to be unlawful, void, or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

CHILDREN'S PRIVACY AND PARENTAL CONTROLS

Eligibility: Contests & Giveaways (the “Sweepstakes”) are open only to those who purchase a Pipsticks Monthly Subscription or sign up using the ‘No Purchase Necessary” instructions The sweepstakes is void where prohibited by law. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Pipsticks Inc., as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.

Sweepstakes Period: Monthly sweepstakes run from the 1st to the 31st of each month, ad-hoc sweepstakes will have time frames listed on each platform they are run on.

Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Pipsticks Inc.. No cash or other prize substitution permitted except at Pipsticks Inc.’s discretion. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Odds: The odds of winning depend on the number of eligible entries received.

Winner selection and notification: Winners of the Sweepstakes will be selected in a random drawing under the supervision of the Pipsticks Inc.. Winners will be notified via email to the email address they entered the Sweepstakes with within five (5) days following the winner selection. Pipsticks Inc. shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction.
